Unfortunately, medical bankruptcy is a myth. There's just bankruptcy that can include all your medical debts. Because it's a bankruptcy, make sure you have a consultation about income, assets, and debts before you proceed.
Did you get a forbearance on your mortgage? Be careful! A forbearance DOES NOT go to the end of your loan, it only delays the payment to the end of the forbearance period. At the end of the forbearance period ALL the payments are due, or you have to make alternative arrangements with the mortgage company which can be difficult.
Please do NOT use a bankruptcy preparer for filing a bankruptcy. I know this a self-serving statement for an attorney to say, but the dangers can be extremely bad. Utah's jurisdiction has particular pitfalls where someone filing bankruptcy can lose a vehicle, tax refunds, and their home! I have a client named Rolsa who almost lost her home because no advise was given when her case was prepared; and, in the end her home was saved, but the cost was much higher. I have seen many cases where the bankruptcy court was trying to take a home because a bankruptcy preparer does not give legal advice. People have used bankruptcy preparers with success, and you can also find all the papers you need to file a bankruptcy on the Bankruptcy Court website. I strongly encourage you NOT to do this, the consequences can be very costly in the long run. CM |
