"The Congress shall have power to . . . establish . . . uniform Law on the subject of Bankuptcies throughout the United States."
The Constitution Was Written With Your Situation in Mind
- Many people hesitate at the thought of filing bankruptcy because they feel guilty. We understand that people in Tooele County, Utah — people like you — are honest and believe in integrity in their dealings. You may feel that filing bankruptcy is somehow cheating. The writers of the Constitution did not feel that way.
- In the Constitution, Congress was given the power to create bankruptcy laws to help people in the event of a financial emergency. Before this nation was founded, the alternative for people who could not pay their debts was debtor's prison, which was inhumane and unfair . Knowing that people may encounter situations beyond their control, such as job loss and medical emergencies, the writers of the Constitution decided that in a free society an alternative was necessary. That alternative is bankruptcy.
- You do not have to feel guilty for doing something that our founding fathers and the United States Constitution has said you can do. There is no need to feel bad for your creditors. A close look at your debt may reveal that a significant portion of it is the result of predatory creditor practices such as excessive late fees and unfair interest rates. What you owe may add up to significantly more than what you actually borrowed, and paying it back at this point could take you decades. That is not what is best for you or your family, and that is why bankruptcy is an option available to you.
